Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the StayInKos website at stayinkos.gr and all related services, applications, and features (collectively, the "Platform"). By accessing or using StayInKos, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

StayInKos is operated from Kos, Greece and governed by Greek and European Union law.

2. Who We Are

StayInKos is a local hospitality marketplace and property management platform serving the island of Kos, Greece. We provide:

• A traveler-facing booking marketplace for finding and reserving accommodation in Kos.
• MyPMS — a property management system (PMS) for accommodation providers.
• StayInKos Distribution Network — a channel management service connecting properties to OTAs (Booking.com, Airbnb, Expedia, etc.).
• Ancillary tools including Yield Manager, Review Boost, and guest journey automation.

3. User Accounts

To access certain features of the Platform, you must create an account. You agree to:

• Provide accurate, complete, and current information during registration.
• Maintain the security of your password and notify us immediately of any unauthorised access.
• Be responsible for all activity that occurs under your account.
• Not create accounts on behalf of others without authorisation.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Bookings and Payments

4.1 For Travelers

When you make a booking through StayInKos, you enter into a contract directly with the property owner/host. StayInKos acts as an intermediary facilitating the booking and, where applicable, payment processing.

• All prices are quoted in Euros (EUR) and include applicable taxes unless otherwise stated.
• A city tax (municipal accommodation tax) applies per adult per night as required by Greek law.
• Payment is processed securely via Stripe. By providing payment details you authorise us to charge the amount shown at checkout.
• Your booking is confirmed only upon receipt of a confirmation email with a booking reference number.

4.2 Cancellations and Refunds

Cancellation policies vary by property and rate plan. The applicable policy is shown clearly before you complete your booking. StayInKos facilitates refunds in accordance with the property's stated policy. In cases of dispute, StayInKos may mediate but is not liable for the property's independent cancellation decisions.

4.3 No-Shows

If you fail to arrive on your check-in date without prior notice, the property may charge the full amount of the booking in accordance with their cancellation policy.

5. Host and Property Owner Terms

If you list a property on StayInKos, you agree to the following:

• You are the legal owner or authorised manager of the property and have the right to list it for short-term rental.
• All property information, photos, pricing, and availability you provide is accurate and not misleading.
• Your property complies with all applicable Greek laws and regulations, including short-term rental registration (MITA number) requirements, fire safety standards, and local zoning rules.
• You will honour confirmed bookings made through the Platform and maintain the advertised standard of accommodation.
• StayInKos charges a commission or subscription fee as agreed in your partnership plan. Current rates are available on our Pricing page.
• You are responsible for collecting and remitting the municipal city tax to Greek tax authorities.
• You consent to StayInKos distributing your availability and rates to connected OTA channels as part of the Distribution Network service.

6. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms.
• Circumvent the Platform to conduct bookings or payments outside of StayInKos in order to avoid fees.
• Post false, misleading, or defamatory reviews or content.
• Attempt to gain unauthorised access to any part of the Platform or other users' accounts.
• Use automated scraping, bots, or data harvesting tools on the Platform.
• Transmit viruses, malware, or other harmful code.
• Harass, threaten, or abuse other users, hosts, or StayInKos staff.

7. Reviews and User Content

Users may submit reviews and other content to the Platform. By submitting content, you grant StayInKos a non-exclusive, royalty-free licence to display, reproduce, and distribute that content on the Platform. You confirm that your content is truthful, based on genuine experience, and does not infringe the rights of any third party.

We reserve the right to remove content that violates these Terms, is fraudulent, or is otherwise inappropriate, at our sole discretion.

8. Intellectual Property

All content on the Platform — including the StayInKos name, logo, design, software, text, and graphics — is owned by or licensed to StayInKos and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Platform without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• StayInKos acts as an intermediary marketplace and is not a party to the accommodation contract between guest and host.
• We are not liable for the quality, safety, legality, or suitability of any property listed on the Platform.
• We are not responsible for indirect, incidental, or consequential damages arising from your use of the Platform.
• Our total liability in connection with any claim arising from these Terms shall not exceed the total fees paid by you to StayInKos in the 12 months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless StayInKos, its directors, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from your violation of these Terms, your use of the Platform, or your interactions with other users or hosts.

11. Third-Party Services

The Platform integrates with third-party services including Stripe (payments), Channex (channel management), Resend (email), and Twilio (SMS). Your use of these services is also subject to their respective terms of service and privacy policies. StayInKos is not responsible for the availability or conduct of third-party services.

12. Governing Law and Disputes

These Terms are governed by the laws of Greece and the European Union. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Kos, Greece, without prejudice to your rights as a consumer under EU law.

For EU residents, the European Commission's Online Dispute Resolution (ODR) platform is available at ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Platform at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
